Acceptable Use & Anti-Spam Policy

This Acceptable Use & Anti-Spam Policy (the "AUP") is part of the Terms of Service and applies to everyone who uses the Fynlix Service — including every message sent through it, every page published with it, and every product sold through it. Where you have a team, clients or affiliates, you are responsible for their compliance too.
We combine acceptable-use and anti-spam rules in one policy deliberately: Fynlix sends email and SMS on your behalf, and abusive sending by one customer damages deliverability for everyone. These rules protect you, your recipients and the platform.
1. Anti-spam rules (email, SMS and messaging)
1.1 Consent first. You may send marketing messages only to recipients who have given the consent required by the laws applicable to you and them (for example prior opt-in consent under EU ePrivacy rules and the GDPR), or where you have another clear legal basis (such as the existing-customer exception, where it applies, with an opt-out offered at collection and in every message). If you cannot demonstrate how a recipient got on your list, do not message them.
1.2 Prohibited lists. You must not send to purchased, rented, traded, scraped or harvested lists, to addresses collected by a third party without message-specific consent ("co-registration"), or to appended or guessed addresses. Contest, viral or chain-mail lists count as no-consent lists.
1.3 Identification and honesty. Every marketing message must truthfully identify you as the sender (including, where required, your postal address), use accurate header information and non-deceptive subject lines, and never impersonate any person, brand or system notification.
1.4 Unsubscribe. Every marketing email and SMS must contain a clear way to opt out. You must not remove, hide or disable the unsubscribe mechanisms provided by the platform, and you must honour every opt-out promptly (at most within the period required by law) and permanently. Transactional messages (receipts, delivery updates) may omit marketing content and unsubscribe links but must not be used to smuggle marketing.
1.5 SMS specifics. SMS marketing requires prior express consent, sender identification, opt-out honouring (for example STOP), and respect for quiet hours and other rules of the recipient's jurisdiction and carrier.
1.6 Reputation thresholds. We monitor aggregate signals (bounce rates, complaint rates, blocklistings). If your sending materially exceeds industry norms for bounces or complaints, or triggers blocklisting, we may throttle, pause or block your sending while we work with you to fix the cause. List hygiene is your job: remove hard bounces and long-inactive addresses.
1.7 Your own infrastructure. These rules apply equally when you connect your own SMTP server or sending domain through Fynlix.
2. Prohibited content and businesses
You may not use the Service (including published pages, checkouts, media storage and AI features) to promote, sell, host or distribute:
- Anything illegal under the law applicable to you or your audience, or that facilitates illegal activity.
- Phishing, malware, spyware, or content designed to deceive people into revealing credentials or personal data.
- Fraudulent, deceptive or unsubstantiated offers — including fake scarcity or fabricated testimonials, reviews or social proof; "get rich quick", pyramid or Ponzi schemes; multi-level-marketing recruitment funnels that emphasise recruitment over product; and misleading earnings or health claims.
- Content that infringes intellectual-property or personality rights (counterfeit goods included).
- Child sexual abuse material (reported to authorities immediately), pornography, or escort services.
- Violent extremism, incitement, or content that harasses, threatens or discriminates against people based on protected characteristics.
- Weapons, explosives or related components; illegal drugs or drug paraphernalia; smart drugs or substances making unapproved medical claims.
- Regulated products or services offered without the required licence or mandatory disclosures — including pharmaceuticals, medical devices and treatments, financial services, credit and investment products, cryptocurrency offerings, gambling and lotteries, alcohol and tobacco/vaping.
- Personal data of third parties offered for sale, or any use of the Service as a data broker.
We may decline categories that create disproportionate abuse, deliverability or payment risk even where legal; your payment processor and carriers may impose stricter rules than ours.
3. Prohibited technical behaviour
You must not:
- Probe, scan or test the vulnerability of the Service, bypass authentication or security controls, or access data of other customers or any non-public area (report suspected vulnerabilities to support@fynlix.com instead — good-faith reports are welcome).
- Introduce malware, run denial-of-service attacks, or place unreasonable load on the platform (including abusive crawling or scraping of the Service or of pages published by other customers).
- Circumvent plan limits, quotas, Credit metering, trials or fees — including by creating multiple free workspaces to multiply quotas, laundering usage through the API, or manipulating metering.
- Share, sell or transfer accounts or seats; use one seat for multiple people; or resell access to the Service except as your plan expressly permits.
- Use the Service to build a competing product, or systematically extract its templates, prompts, content libraries or design assets.
- Mine cryptocurrency, run unrelated compute workloads, or use AI features to generate content prohibited by this AUP or by the model providers' usage policies.
- Register misleading workspace names, subdomains or custom domains (typosquatting, brand impersonation).
4. Affiliate and lead-generation abuse
Whether you run your own affiliate program on Fynlix or drive traffic as an affiliate: cookie stuffing, forced clicks, misleading advertising, unauthorised brand bidding, incentivised fraudulent signups, fake leads and traffic bots are prohibited. You are responsible for the practices of affiliates promoting your funnels.
5. Enforcement
5.1 Graduated response. Depending on severity, we may: warn you; require list or content remediation; throttle or pause sending; unpublish specific content; suspend features, workspaces or the Account; remove content; or terminate under Section 18 of the Terms. For serious violations (illegal content, phishing, CSAM, active attacks) we act immediately and without notice.
5.2 Monitoring. We do not pre-screen Customer Content, but we may use automated signals (complaint and bounce rates, abuse reports, malware scanning, anomaly detection) and review flagged content or sending patterns to enforce this AUP.
5.3 No refunds for enforcement. Fees are not refunded for suspensions or terminations caused by your violation of this AUP.
5.4 Legal reporting. We report content and conduct to authorities where the law requires, and we cooperate with lawful investigations.
6. Reporting abuse
To report spam, phishing, fraudulent pages or any other abuse of the Service, email abuse@fynlix.com with the URL or message concerned, what you observed, and (for email) full headers where possible. We review every report. If you received unwanted email sent through Fynlix, use its unsubscribe link and — if you believe it was sent without consent — forward it to abuse@fynlix.com.
7. Changes
We may update this AUP as abuse patterns and laws evolve, following the notice process in Section 20.1 of the Terms. The current version and its effective date are published on this page.
